User Obligations

As a user of our services, you agree to comply with all applicable laws and regulations. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using our services for any unlawful purpose or in violation of any applicable regulations
• Attempting to gain unauthorised access to our systems or other users' accounts
• Interfering with or disrupting the operation of our services
• Transmitting any malicious code, viruses, or harmful software
• Reverse engineering, decompiling, or attempting to extract source code from our platform

Data Accuracy

Intellectual Property

The parahubuxae analytics platform, including all software, documentation, designs, graphics, and content, is the exclusive property of parahubuxae AG and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you are reserved by parahubuxae.

User Content

You retain ownership of any data, content, or materials you upload to or input into our services. By using our services, you grant parahubuxae a non-exclusive, worldwide licence to use, process, and analyse your data solely for the purpose of providing our analytics services to you.

Feedback and Suggestions

Any feedback, suggestions, or ideas you provide to parahubuxae regarding our services may be used by us without any obligation to compensate you. You acknowledge that such feedback becomes the property of parahubuxae.

Payment Terms

Payment for our services is due according to the billing schedule specified in your service agreement. All fees are non-refundable unless otherwise stated in your specific service agreement or required by applicable law.

If payment is not received when due, we reserve the right to suspend or terminate your access to our services. You are responsible for all costs associated with the collection of overdue amounts, including reasonable legal fees.

Service Availability

We strive to maintain high availability of our services but cannot guarantee uninterrupted access. Our services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance.

Limitation of Liability

To the maximum extent permitted by law, parahubuxae AG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of our services.

Our total liability to you for all claims arising out of or relating to these terms or our services shall not exceed the amount you have paid to parahubuxae in the twelve months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

Indemnification

You agree to indemnify, defend, and hold harmless parahubuxae AG, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of our services, violation of these terms, or infringement of any third-party rights.

Data Protection and Privacy

Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Termination

Either party may terminate this agreement at any time with appropriate notice as specified in your service agreement. We may terminate your access to our services immediately if you violate these terms or engage in any prohibited activities.

Upon termination, your right to access and use our services will cease immediately. We will provide you with reasonable access to export your data for a limited period following termination, subject to our data retention policies.

Effect of Termination

Termination of these terms will not affect any rights or obligations that have accrued prior to termination. Provisions that by their nature should survive termination will continue in effect, including but not limited to intellectual property rights, limitation of liability, and governing law.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Austria, without regard to its conflict of law principles. Any disputes arising out of or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts of Austria.

If you are a consumer located in the European Union, you may also have rights under local consumer protection laws, and nothing in these terms is intended to limit those rights.

Severability

Entire Agreement

These Terms of Service, together with our Privacy Policy and any specific service agreements, constitute the entire agreement between you and parahubuxae regarding our services and supersede all prior or contemporaneous communications and proposals.
